Terms & Conditions

  1. Introduction

    1. These terms and conditions ("Terms") govern the sale of Goods and provision of Services by The Rug Group Limited ("we", "us", "our") a company registered in Scotland with company number SC506844 whose registered office is at 22 Stafford Street, Edinburgh, Scotland, EH3 7BD. We operate through the following trading entities:
      1. The London Persian Rug Company (londonpersianrugcompany.co.uk) ("LPRC") for the sale of rugs and related Goods.
      2. The Oriental Rug Repair Company (orrc.co.uk) ("ORRC") for the provision of rug repair and restoration Services.
    2. By placing an order for Goods or Services, you ("you", "the Customer") agree to be bound by these Terms.

  2. Definitions

    1. "Goods" means any rugs, carpets, or other products sold by LPRC.
    2. "Services" means any rug repair, restoration, cleaning, or other services provided by ORRC or LPRC.
    3. "Website" means the websites londonpersianrugcompany.co.uk and orrc.co.uk
    4. "Order" means an order placed by you for Goods or Services through the Website, by telephone, or in person.

  3. Formation of Contract

    1. All Orders are subject to acceptance by us. We reserve the right to refuse any Order at our discretion.
    2. These Terms constitute an offer by us to supply Goods or Services. Your Order constitutes an offer to purchase Goods or Services from us.
    3. A legally binding contract for the sale of Goods or provision of Services ("Contract") is formed when we send you an email confirming your Order ("Order Confirmation").
    4. No variation of these Terms shall be binding unless agreed in writing by us.

  4. Goods

    1. Descriptions: Every effort is made to ensure that the descriptions and specifications of the Goods on our Website are accurate. However, slight variations in colour, texture, and appearance may occur. Images of the Goods on the Website are for illustrative purposes only.
    2. Availability: All Goods are subject to availability. We will inform you as soon as possible if the Goods you have ordered are not available and offer you an alternative product or a full refund.
    3. Delivery: * Delivery times are estimates only and may vary. * We will use reasonable endeavours to meet any date agreed for delivery. However, time of delivery shall not be of the essence of the Contract. * We are not liable for any delays caused by circumstances outside our control. * Risk of loss or damage to the Goods passes to you upon delivery.
    4. Returns: * You may return Goods within 14 days of receipt if they are faulty or not as described, in accordance with your statutory rights under the Consumer Rights Act 2015. * Please see our separate Returns Policy on the Website for full details of your statutory rights.

  5. Services

    1. Estimates: We will provide you with an estimate for the Services before commencing work. The estimate is an approximation and the final price may vary depending on the condition of the rug and the complexity of the work required. We will notify you of any significant variation from the estimate and seek your approval before proceeding with the work.
    2. Completion: We will endeavour to complete the Services within the estimated timeframe. However, delays may occur due to unforeseen circumstances. We will endeavor to keep you informed of any delays.
    3. Collection and Delivery: Arrangements for the collection and delivery of rugs for Services will be agreed upon between you and ORRC. Risk of loss or damage to the rug shall pass to you upon delivery back to you.
    4. Liability: We will take reasonable care of your rug while it is in our possession. However, we are not liable for any damage that has occurred due to pre-existing conditions or inherent weaknesses in the rug, with the exception of such damage that is caused by our negligence.

  6. Price and Payment

    1. Prices for Goods and Services are as displayed on the Website or as quoted to you. Prices are subject to change without notice.
    2. Payment can be made by - Bank transfer, online card payment or cash.
    3. We reserve the right to charge interest on overdue accounts at the rate of CPI % per annum above the Bank of England base rate.

  7. Limitation of Liability

    1. Nothing in these Terms excludes or limits our liability for:
      1. Death or personal injury caused by our negligence.
      2. Fraud or fraudulent misrepresentation.
      3. Any breach of the terms implied by section 12 of the Sale of Goods Act 1979 (title and quiet possession).
      4. Any other liability that cannot be excluded or limited by law.
    2. Subject to clause 7.1, our total liability to you in respect of any Contract shall be limited to the price of the Goods or Services.
    3. We are not liable for any indirect, consequential, or special damages arising out of or in connection with any Contract.
    4. We shall not be liable for any loss or damage to items once they are handed over to a third-party courier, provided that the client has explicitly agreed to the use of such courier services. The client hereby accepts full liability for any incidents, including but not limited to loss, damage, or delay, that may occur during the transportation of items by the third-party courier.

  8. Intellectual Property

    1. All intellectual property rights on the Website and our Goods and Services are owned by us or our licensors. You are not permitted to copy, reproduce, modify, distribute, or display any of our intellectual property without our prior written consent.

  9. Data Protection

    1. We will use your personal information in accordance with our Privacy Policy, which can be found on the Website. Our Privacy Policy complies with the UK General Data Protection Regulation (UK GDPR) and the Data Protection Act 2018.

  10. Force Majeure

    1. We shall not be liable for any delay or failure to perform our obligations under any Contract due to any cause beyond our reasonable control, including but not limited to acts of God, war, terrorism, riots, embargoes, strikes, lockouts, trade disputes, fires, floods, epidemics, earthquakes, or other natural disasters.

  11. Entire Agreement

    1. These Terms constitute the entire agreement between you and us in relation to the subject matter hereof and supersede any prior agreements, representations, or understandings.

  12. Governing Law and Jurisdiction

    1. These Terms and any Contract shall be governed by and construed in accordance with the laws of England and Wales.
    2. Any dispute arising out of or in connection with these Terms or any Contract shall be subject to the exclusive jurisdiction of the courts of England and Wales.

  13. Notices

    1. All notices shall be in writing and sent to the address set out in these Terms or such other address as may be notified by either party to the other.

  14. Severability

    1. If any provision of these Terms is held to be invalid or unenforceable, such provision shall be struck out and the remaining provisions shall remain in full force and effect.

Specific Considerations for LPRC and ORRC:

LPRC:

  • Authenticity of rugs: All rugs sold by LPRC are guaranteed to be genuine and as described. We can provide certificates of authenticity where applicable.
  • Grading and condition descriptions: Vintage and antique rugs are graded according to their condition and age. We use a grading system and provide detailed descriptions of any imperfections.
  • Care instructions: We provide care instructions for all rugs sold by LPRC.

ORRC:

  • Assessment of rug damage: We will conduct a thorough assessment of the damage to your rug and discuss the repair options available.
  • Use of materials: We use high-quality all natural materials in all our repairs, including dyes and threads that are carefully matched to the original rug.
  • Customer approval: We will obtain your approval before finalising any repairs or maintenance.
